Bush Signs New Anti-Piracy Law

2008-10-16 by Trey STAFF | 77 Comments
In an effort to upset just a few more people before leaving office President Bush signed a bill on Monday October 13th that creates strict penalties on those that pirate movies, software and/or music. This new law creates a position for an "intellectual property czar" that reports directly to the president on all piracy matters. It also allows for the removal of any device used for piracy, which means that they can take your computer away from you as well as any other device carrying the pirated material (i.e. iPods).

Of course, backing the bill were great organizations including The Recording Industry Association of America and Motion Picture Association of America, as well as the U.S. Chamber of Commerce.

Boo hoo hoo... if you can't see that the problem isn't that people shouldn't pirate shit, it's that the RIAA and other corporations are suing people for 100 times the cost per a song and now they're going to take people's computers and iPods. It's clearly a matter of these corporations using their power to abuse people. Yes, piracy is a a crime, but the coprorations are taking it too far.

Thanks. I think people should have the ability to hear the entire album before they buy it, but that they should buy it if they're going to keep it.

The recording industry took advantage of people before the internet took off because they could package an album with two good songs and the rest filler and no one would even know until they had already paid for it. Then when CDs came out they were actually cheaper to manufacture, but the record companies never lowered their prices, in fact they steadily increased and they were still screwing their customers with filler material. That is one of the reasons they fought iTunes and didn't want to allow them to sell songs individually (but they had no choice since it was that or keep watching people download the two good songs from an album and not pay anything). This Message Edited On 10.16.08

This is my opinion. Little 30 clips of songs don't show you anything.
If it's a band I'm not sure about I'll d/l it. If it's any good I'll buy it.
Places like Oink introduced me to a lot of new bands I never would have heard of otherwise. Bands, who are getting my money now.
I don't like Itunes because m4a format is crap IMO. Also when they first started allowing the purchase of individual songs the bitrate was garbage.

I agree that 30 second samples aren't generally good enough. I'll try their official site, Myspace or Last.Fm before downloading the songs from the net. I've found a lot of bands through Last.fm actually.
I also agree that the m4a format is crap but I support iTunes anyway because apple isn't giving in to the record companies the way that Microsoft was going to. If Microsoft's online music distribution had taken off we'd have no freedom at all with our music.

The thing seems to be is the RIAA and such orgs take everything to the extreme immediately. The amount they were charging people for having the music was ridiculous and instead of trying to find a way to make the internet work to their advantage they shunned it.

And they're still trying to shun the internet or at least make it work so that they can still rip off their customers. Itunes has 85% of the digital music market, but the record companies still won't let them sell the music without DRM. They're trying to weaken iTunes by lettting everyone else (Amazon, etc) sell without DRM. The reason they're doing this is because Apple refuses to let them gouge their customers by selling popular albums for more than other albums. They also won't let them sell whole albums instead of single tracks and the record companies aren't liking it.

The country song quote was a joke. It is infringement when the record companies are given the power to have our computers taken away, and they're given the power to ruin someone's financial situation for the rest of their life. Bush is simply ruling in favor of where the money is coming from.

Something needs to be done, but not what they're doing. Do you think any of the money they're collecting from these court cases is really going to the artists? What about those record labels that aren't part of the RIAA when the RIAA sues? Do they give those indie labels money when it's their bands being ripped off... no, they don't.This Message Edited On 10.16.08

No, the Zune store hasn't tanked yet. Look up their last music venture "Plays for Sure" when they were working with multiple mp3 vendors and simply pulled the plug when they lost interest in it. Or Yahoo Music pulling the plug on their customers and leaving them with nothing. So basically you're paying $180 a year for something that can be taken away on the whim of accounting or any CEO.

That is true if they're on a major label, not so much if they're on an indie. Either way that's not a good enough reason because it's the labels that pay for recording, advertising, etc and if they're not seeing a return then your favorite band just got dropped.

record companies get the huge majority of album sales and what not, so i'd rather support the artists by buying merch and going to shows. all of these laws are because the record companies are bitching about not making enough money.
most artists are only concerned about leaks and shit because it's not what they intended to put out. i don't understand why bands like metallica are the industry's bitch, but whatever.

Piracy, whether you like it or not, is stealing and i dont see how the government is infringing on your freedoms by enforcing the lawa against stealing. Just because you're taking the music on the internet versus in your hands doesnt mean its not stealing. The medium is irrelevant to the action.

I'm a little curious as to what the Intellectual Property Czar's priorities are going to be. Are people who download the most popular music, and movies, going to be the target, or is it just at random? I can't see them targeting people who d/l obscure death and black metal since they don't rake in the bucks like, say, Metallica, Slipknot, or any pop and/or hip-hop group does. I understand that piracy is, essentially, theft, but if I have the money and like an album, I buy it. You don't buy a car without test driving it first. Why can't that apply to CDs as well? (I know you can't keep a digital file of the car like you can music. Just sayin.) I generally delete stuff if I don't like it, and keep the stuff I plan on buying so I don't forget about it. I'm sorry if I love music, but can't afford to buy everything because I'm broke. Maybe if everything wasn't so damned expensive more people would purchase albums. Also, I wonder what the Czar listens to...

Also, Canada isn't so light on music downloading anymore. A couple of months back a new law was passed, and if you infringe any copyrighted material including music, you could face fines of $500 per infringement (song).

Every CD I've bought in the last two years, I downloaded first. Before that I bought hundreds of dollars worth of CDs that I bought because i liked a song i heard or their last album and the albums SUCKED. So I started downloading to get a feel of the album and if it was really worth spending 15 bucks on, i went out to Best Buy or my local record store and threw down the cash for it. Maybe if record companies would stop putting out so much shitty music they wouldn't have this problem.

Man our president needs to chilax, and pass that joint hes been on for a few years. He spends countless amounts of money on rediculous things. How much money does it cost to create a division against piracy, millions i'd say. Great now we can all get raped by companies who over charge us for something that is a tool of relieving bad emotions. Music isn't property, it's free flowing and has existed before money existed. 15 dollars a cd or album is rediculous. Maybe, if they lower their prices we'd all buy it. I know i'd be more inclined to pay for a $5 dollar album. Come, knock on my door and then i'll knock you out of my door way. This is one more waste of money that battles our right to the pursuit of happiness. God bless Americam, land against the free and home of the slaves. This Message Edited On 10.22.08
