The US blogger who leaked nine demos from Guns N' Roses's 2008 album Chinese Democracy has been sentenced to a year of probation and two months of home confinement for his role in the crime.
Appearing in a Los Angeles court, Kevin Cogill was spared a prison term by the judge, who took into account the defendant's guilty plea and the fact that had already lost his job as a result of his prosecution. He faced a possible fine of $250,000 and three years in prison.
Cogill was, however, ordered to appear in an anti-piracy commercial on behalf of the RIAA, to be broadcast during the Grammy Awards in January. So far, neither Guns N' Roses nor Geffen Records have taken any civil action against the defendant.
Cogill apologised in court, telling Judge Paul L. Abrahams: "I never intended to hurt the artist. I intended to promote the artist because I'm a fan."
At the time he posted the leaks, Cogill appeared cocky, boasting: "I’m probably asking for a lot of trouble. But I’m fighting the good fight. It’s not against the label, or the artist- it’s against the old business model. The obsolete marketing paradigm. Release your music. Give it away, let everyone hear it. If it’s good, you’ll be OK." FBI agents raided his home later that week.
Chinese Democracy was finally released in November of 2008 following almost a decade of leaks, aborted tours and rumoured release dates. Frontman Axl Rose has since refused to publicise the album, aside from one interview with Billboard (his first in nine years). As such, the ruling is only the second time the album has been promoted since its release.
