Fall Out Boy To Be Sued Again

The Philadelphia Inquirer is reporting that local artist Nicholas Hans, of now-defunct hardcore group Knives Out, is contemplating suing multi-platinum act Fall Out Boy for the alleged theft of a song lyric.

The lyric in question reads, "The ribbon on my wrist says, 'Do not open before Christmas,'" and is taken from the ironically-titled 'Our Lawyer Made Us Change the Name of This Song So We Wouldn't Get Sued' from 2005's From Under The Cork Tree. The track was originally entitled 'My Name is David Ruffin... And These Are The Temptations.'

While on tour in 2001, Knives Out produced and sold a t-shirt which they allege led to the plagiarism. The t-shirt depicts a hand with a blue ribbon tied around the wrist. The tagline beneath reads, "Don't Open Till After X-Mas."

This isn't the first time Fall Out Boy have been taken to account over such infringements. Wesley Eisold of Boston hardcore band American Nightmare successfully exacted three songwriting credits from the band for tracks on the album Infinity On High, while he's also listed as "inspirador" of the song 'Tear Chaser' from Cork Tree.

"They 100 percent ripped us off," Hans told the Inquirer. "It just pisses me off. They should have asked."

Now that he's seen how much money FOB have made off of the album, he can be sure that if he wins this case, he'll walk off with a good chunk of change.
