Leona Lewis Battles Injunction 2011-08-06 by Kiran EMERITUS | 13 Comments | X-Factor winner Leona Lewis faces a battle to get her latest single, "Collide", released following an injunction plea from Swedish DJ/producer Tim Bergling (more popularly known as Avicii). Bergling alleges that "Collide" is a straight copy of his own song "Fade Into Darkness", which previously made rounds under a different title as the vocal-less "Penguin".
According to the DJ's manager, "Penguin" was sent out with the intent of enticing a singer to add vocals to the track but rejected the initial recording of "Collide", as they were already some way towards completing what would turn out to be "Fade Into Darkness". He believes the "Collide" demo was then pitched successfully to Lewis' people without his consent; leading to the two singles now finding themselves at odds.
Bergling's label, Ministry of Sound, stated: "Avicii is an up-and-coming talent; we think he should be given a fair crack at making this record the hit it deserves to be". Although Lewis' label, Syco (famously operated by Simon Cowell), has not given any official statement, she has been quoted saying that she believed Avicii's team knew all about the single and had personally cleared it for release. Bergling responded angrily with the fact that he had never met the singer.
The hearing is scheduled for August 8th.
