Wilco Sued By Former Member 2009-05-06 by Iai EMERITUS | 12 Comments | Jay Bennett, the former Wilco member who contributed songwriting credits to albums like Summerteeth and Yankee Hotel Foxtrot, has filed a lawsuit against the band for outstanding royalties he feels he is owed since his departure.
Although it also includes performance rights for songs the band have played live (some of which were included on the live album Kicking Television), the cruz of the suit appears to be the movie I Am Trying To Break Your Heart, which largely centered on Bennett's departure from the group and the breakdown of his relationship with main songwriter Jeff Tweedy. It is claimed that Tweedy "never obtained the necessary releases for the use of Bennett's performance in the film".
Tweedy, for his part, has released the following statement:
"I know exactly as much as everyone else does. I've read the news and I honestly have no idea what these claims are based on. It was such a long time ago. Aside from everything else, I'm being sued for not paying someone for appearing in a movie I didn't produce. Go figure. I am truly sad it has come to this. I am equally convinced, however, that I have done nothing wrong and that this will be handled fairly and swiftly."
Bennett, who predominantly played guitar for Wilco, left the group in 2001. The full text of the lawsuit can be found at:
