Why would you want to sue someone who is broke? The photographer most likely makes less than the band. And of course she is going to wait until they make money before she does anything. Litigation costs a lot, and she wants as much cash as possible. I agree with Starclassic. They need to figure this stuff out before releasing the album.

I'm not clued in on how the modelling industry works but I figured if this guy took her photos and then sold them she would be eligible to a percentage of whatever the photographer sold them for, not a percentage of whatever the person/people who used the picture earned.
