Hinds' Estate Sues Mastodon

The estate of former Mastodon guitarist and vocalist Brent Hinds has filed a lawsuit against the band over his share of its businesses and the alleged unauthorized use of his likeness.

Filed September 3 in Fulton County Court, Georgia, the complaint names Troy Sanders, Bill Kelliher and Brann Dailor as defendants. The estate alleges that Hinds retained ownership interests after his March 2025 departure because he never signed a proposed buyout agreement before his death.

According to the complaint, the band subsequently sent the estate an $80,000 check without explaining how that amount had been calculated. The estate says it has left the check uncashed pending a full accounting.

The lawsuit also challenges the use of an image allegedly depicting Hinds on the cover of "Marrow Deep" and related promotional material. It further criticizes the band for publicly discussing aspects of his private life following his death.

Mastodon has denied wrongdoing, describing the lawsuit as meritless and stating that it intends to defend itself vigorously. The band said it would avoid further public discussion out of respect for Hinds' memory and musical legacy.

Hinds died in a motorcycle crash in August 2025, five months after leaving the group.

dude i've been staring at the album artwork for a good minute or two and i cannot even spot brett hind's face

it's clearly not done that identifiably if i can't see it even when i'm looking for it

I’m no expert on what his share is worth, that could have merit and I’d have no idea. That said, I think it hurts the perceived validity of your motives to wrap that up with the use of his likeness on the album cover (clearly a tribute to their dead band mate) and that they talked about the personal stuff that was going on behind the scenes before his ousting.

the issue is in the pasted excerpt at the top of this thread, the parties want to see the accounting rigour, not be tricked by an attorney handing them a possibly lowball lumpsum check and forfeiting the dude's life's work. there should be zero controversy about that

No, right hand side under the bat-lady face, there’s a bunch of little skulls and underneath there are four heads, and the third one is Brent, in line with the bell hanging from the sleeve. It’s not super prominent but you can find it.

the 'using likeness' thing just seems like the lawyer throwing anything hoping it can stick, the payout/bandshare/royalties probably gonna need more legal work than a check tho. who'd even be his estate though like does he have kids or is it like his parents or siblings. the economics of being a touring bands kinda fucked so there is probably some smoke there regardless if the actual band members are aware of it.

and yeah i've seen the album cover like a dozen times in the past month and at no point did i go 'oh hey that looks like brent hinds'
