Gibson Sues Guitar Hero Makers

Gibson Guitar Inc. have ordered Activision, the company behind the Guitar Hero franchise, to cease sale of the games until such a time as they obtain a license to do so.

Gibson filed a patent in 1999 for technology to simulate a live concert performance, however have worked closely with Activision in the three-year existence of the Guitar Hero franchise, going so far as to license the Les Paul guitar as a model for a game controller.

However, in a letter sent to Activision, Gibson claimed that the Guitar Hero concept fell under the terms of its patent, and demanded the games be stripped from the shelves until such a time as a licensing agreement was arranged. Activision have filed a claim with a California court to declare the patent invalid and bar Gibson from seeking damage.

No, Harmonix is in charge of Rock Band. I don't think Rock Band has any Gibson ties anyway.

Personally, I think Gibson is just trying to rip Activision off. If they were really offended by something like this, Gibson would've done this 3 years ago when Guitar Hero first came out.

Ha! It's hilarious. Guitar Hero and Rock Band are massive successes so everyone will jump at the chance to get in on some of that money some how. This isn't the first of these weird suits and it prolly won't be the last either.

If you're going to play their little game about the grammar error, at least keep it consistent.

If Gibson is just remembering that they had this patent, quite pathetic book-keeping on their part or whatever. If they just kept it lurking to wait for GH to get big, then this just isn't cricket.

Gibson are making themselves look like utter fools. Look at the case they put up against PRS, sueing their Singlecut model, it's a joke where they never had a chance to win. Predict they'll have no chance as they were part of this collaboration. Wake up, money grabbers, way to build a reputation for your future industry plans.

lawsuits like this are common in the gaming industry, where broad patents like this are the norm rather than the exception. Remember the hit and run Simpson's game? They got sued for the arrow pointing which way to drive, because that idea was patented.
