I know next to nothing about the situation (besides some possibly irrelevant, old, questionable tweets) but it seems to me like Tom is both extremely surprised and, genuinely, heartbroken.

so like, my band opened for Gloryhammer and Alestorm in '18. after the show, our singer (my best friend's girlfriend at the time) disappeared for an hour. turned out she was on their tour bus getting laid while we loaded out. she then dumped my dude for GH's drummer, and they got married and moved to england.

No idea what happened or what the truth is. It must suck to finally get back to playing shows and touring after a year and a half, having literally just played a huge festival, and a couple days later the band emails you to let you know you're fired. Even weirder that they apparently already have someone else ready to fill-in for their upcoming shows. Sounds like they knew this was gonna happen.
I'm not a fan of theirs, but I did see them live at Heavy Montreal 2018 and they were great. Their singer was very charismatic and appropriately over-the-top. The crowd seemed to really like him. It might be hard to recover from losing him. And if he was kicked out for no real good reason, the band just really fucked themselves over.

Allegedly from a lot of what I'm gathering from different media sources it sounds like they didn't like him using the character name when featuring on other bands' projects. That would certainly explain why the initial matter was described as "business related".
Still think it's pretty weak though. Chris Bowes is literally playing the same character in Wizardthrone but that shit is okay somehow

I guess it's been confirmed that he owns the copyright for Gloryhammer. I would die laughing if he rebooted the band with all new members. I'd be entirely ok with it

Trademark, not copyright. And even if the trademark is registered under Winkler's name it might not necessarily mean he's the sole owner or has the sole right to use it.

Yup, I'm not an IP lawyer, but my basic understanding is that registration of a trademark doesn't eliminate the rights of those who were using that trademark before registration. Therefore, when Winkler registered the band name as a trademark in 2019 it would have prevented anyone else from using the same trademark/band name in the future, but would not affect the rights of people already legally using the name, i.e. his bandmates.
Additionally, seeing as how Winkler is apparently a lawyer by training, my assumption is that the band itself likely has formal agreements on the use of the band name which would also have an effect.
