UK Downloaders To Be Listed

2010-06-01 by Skimaskcheck | 47 Comments
Communcations regulator Ofcom have proposed that UK residents who infringe copyright by means downloading music illegally will have their names and details stored on a list as part of the Digital Economy Act 2010.

Users who infringe copyright will receive up to three notifications in a year, after which the user's details would be placed on the list. ISP's would compile these lists of serial copyright infringers, which copyright holders (for example, record companies) would be able to ask for access to, and in turn take action against the infringers.

Though the proposed code would only affect the largest UK Internet Service Providers (BT, Talk Talk, Virgin Media, Sky, Orange, O2 and Post Office), they could be applied to smaller ISP's in the future.

i don't know if this is actually in effect, if anyone could clarify?

'...the Digital Economy Act 2010' would suggest it is though, bad times, UK sucks

So how exactly are they proposing to track all these people?
I would think it's not the easiest thing to track all blogs, torrents and file sharing sites.

Yes it was put through parliment just before the general elections.
Nick Clegg spoke up and said something had to be done (it needs removing and re-thought) seen as it was rushed through parliment in 90 hours or something. So yes it's technically law but I doubt anything will be done yet.

O2, Be and Talk Talk (that's all I know) all issued statements saying they wouldn't give out any details without court order and were certainly against revoking of internet access.

you still aren't on a list until the 3rd notification, so wouldn't you just stop when you got them?

I knew I chose good ol' tesco value broadband for a reason...

at least a reason other than their consistently low speeds and double digit download speeds...

This is a joke... people who download a lot of music generally tend to buy more. I spend almost £500 on music a year, yet I used to spend less than £100.

If I were an artist I'd go with the In Rainbows approach for all my albums. I would be happy as long as people were listening to and enjoying my music, and not trying to get rich off of it.

That's what I'm always saying, but do you think the music industry/authorities actually care to listen?

If I were an artist I'd go with the In Rainbows approach for all my albums. I would be happy as long as people were listening to and enjoying my music, and not trying to get rich off of it.

If being a musician is your profession, then how do you expect to make money if you give everything away for free?

most bands all have part-time jobs and do music as more of a hobby, not as a source of steady income

and by most bands i mean ones not signed to a major label

actually looking through what they're saying you have to receive 3 notifications before you go on the list, and it might take alot for them to send out just 1, we don't know yet. also:

"...targeted legal action against serious infringers."

depending on what they mean by 'serious', it might mean only the worst are sued. but who knows.

FadeToBlack

it's also going to depend on what you're downloading. they're much less likely to notice/care if your dl'ing some kvlt black metal split than if you are like Now That's What I Call Music 1000000

Surely this would only apply to torrents? Surely they wouldn't be able to detect encrypted directlinks or anything? (e.g. rapidshare + cryptload)

Good to be living in Ireland, they honestly don't seem to give a shite here yet (though Dave would probably know more than me about it) although Eircom have threatened action if their users (yup, I be one of those) are caught downloading, though it just seems to be one of those "If you don't stop then I swear to God..." and then nothing happens. We're really too snobby in this country and look at all we have
