Alice in Chains sued
2013-05-18 by Roberto Del Conseccenseio | 63 Comments
The mother of deceased Alice in Chains lead singer Layne Staley has sued her son’s former
bandmates, claiming they cut her out of royalties owed on the band’s hits.
Staley’s mother Nancy McCallum contends the surviving members of Alice in Chains owe her
half of the money due Staley – about 16 percent of the hard rock band’s income. According to
the lawsuit, the band has attempted to cut her out of any further payments.
Attorneys for the band contend McCallum illegally attempted to trademark the Alice in Chains
name and that she has already been paid far more than she is due. Staley’s ex-bandmates also
say Staley’s heirs will be able to collect royalties on songs he wrote or co-wrote, while
arguing McCallum no longer has a role in the band’s business decisions.
Staley was the best known member of Alice in Chains during the band's 1990s heyday, which
saw the release string of hit albums including the quadruple platinum “Dirt.”

The band has not yet responded to the lawsuit, which was filed May 2 in King County Superior
Court.

"fuck this bitch, get a job." [2] but for real, jerry cantrell was pretty much THE creative force behind the band anyway, and, although lane was a great singer, he was and still is not as vital to the band's success as his mommy would like to imagine.

Not from the new albums (assuming he isn't still in the band). Only royalties from the back catalog.

Also, she only filed a lawsuit thus far. AIC ain't sued yet and I hope they don't lose.

so is she suing just for the royalties on the records that layne was involved in, or for something beyond that?

edit: I just looked and she's suing the band for royalties owed to her son. I really don't see a problem with that.

@Dominion

The article is unclear, but it seems she is suing for 16% of ALL revenue earned by the band as part of the revenue sharing agreement that was in place when Layne was alive, so not just the royalties on the back catalog. It seems like she's trying to stake a claim to the AiC name in general and not just the contributions Layne made to it. I could be wrong though. The article is really muddled.

DominionMM1

i looked at some other articles, and it said she's suing for royalties on the albums on which layne wrote/performed. she's not looking for royalties for anything they've done since he died.

SitarHero
May 19th 2013

But the band says that Layne's heirs (which I think is only her) will continue receiving royalties from Layne's work. So I don't understand what the conflict is about. The operative lines (I think) are:

"McCallum claims she’s owed half of all monies due her son, which amounts to around 16 percent of Alice In Chains’ income. "

"Members Sean Kinney and Jerry Cantrell put forth that the financial arrangement between Staley and the band ended with his death."

"According to documents, Alice in Chains has attempted to settle up with McCallum to the tune of $341,000, and that Staley’s heirs would continue to receive royalties from songs he was directly involved in writing."

All of the articles I've seen are sourced from the original Seattle intelligencer article, so link plz if you've found something better.

It's also HIGHLY suspect that she would try to trademark Alice in Chains.

I think, before we go throwing around some youtube-level insults (seriously, are some of you twelve), it's important to establish whether she's staking a claim for the royalties her son had a part in, or also for the newer works. One is understandable, one is not.
