Last.fm to pay bands, sort of

First, the good news: if you're in a band, you can now earn royalties from Last.fm if you upload music to their site. From July 9th onwards, each play will generate a small amount of revenue for both yourself and CBS, the owners of Last.fm.

And now the bad news.

If you've already uploaded your music, you're stuffed. Last.fm are currently not offering to pay users for any past plays, which means that if you uploaded an album and already got all your friends to listen to it, you blew your load too early.

And how about if you're not in touch with anybody else in your band? You're stuffed again. For music to be uploaded, and any money to be generated, you'll need written permission from every member of the band, plus anybody else involved in the making and distribution of the song - producers, engineers, session musicians, label owners, the lot. Oh, and if you're planning on uploading a video, you'll need permission from the cameramen, actors, and anybody who helped you with post-production.

And if you don't own all the rights to your music? Stuffed. Cover songs and any songs using samples are off the menu, as is your entire input if you've ever been signed to a record label, or any company that collects royalties.

Oh, and you also need to nominate one person as a band representative. This person will collect all the money and then - in theory - meter it out to everybody else involved. Having been in a few bands in the past, I know I wouldn't trust at least 80% of my ex-band mates with this responsibility.

Still, if you make music on your own and you have no attachments of any kind, this is no doubt welcome news. Let's all surf over to the Last.fm Equus page and make Eliminator a very rich man.

I remeber signing up to Last.fm a while ago and it asked if we wanted royalties. Obviously, without official copyrights, we had to say no.
