Lawyers for New Zealand-born Urban have filed a suit against New Jersey-based graphic artist Keith D. Urban, accusing him of "CyberSquatting" and operating a website "with the intent to cause confusion," referring to the limited print copies which the painter had sold via his website. The suit points to the apparently misleading text on the site's homepage, which reads:
"You have reached the site of Keith Urban. To those who don't know, oil painting is one of my hobbies." Though the painter does not at any point claim to be the country singer, he is said to have caused "irreparable harm" to the singer and untold financial misfortunes, which can only be partially recitified by the defendant ceding the domain name for the duration of the singer's life, ceasing to trade in a manner which suggests a relationship with the singer and paying a five-figure reparation sum.
The suit also alleges that Keith D. Urban "registered an internet domain name and has structured a website with the intent of producing confusion as to the sponsorship of the website." An odd claim, given that Keith D. Urban registered his website in the US a full five months before the singer released his North American debutalbum, and four months before he registered his current .net domain.
Additionally, the question of why the multi-millionaire, mega-platinum recording artist would commission a website that makes no mention of his music, rather offering modified prints of his oil paintings at $90 a pop, isn't broached at any point in the suit, however it's implied that consumers would be equally oblivious to such irregularities.
As for the suit's claim that the site "mislead them [the public] into believing that the art [contained] was created or otherwise sponsored by the Plaintiff Urban"? Well, nobody could ever accuse him of that, could they?
