Fuck, if this stuff is true (that you are saying), then it's time to find another apartment. Depending on your situation, it can be tough to find one that's within your means, especially with a 4 year old, but this guy sounds like an abusive person, someone to avoid |

10.06.11 | Heres exactly whats been going down. All 1000% truth. Bear with me..... We move in July 20th of this year, we love the place, the downstairs tenant is cool and our neighbor is awesome. Upon moving in, we start hearing stories from our downstairs tenant that our landlord has a tendancy to just walk in whenever he wants. Especially when we're not home. We dont know if he was ever in our house when we werent there but our neighbor said she saw him trying to open our sliding door off our deck. So, next day we confront him and he says, "So when do you guys want to leave?", we say "Huh? We dont want to leave, we just want to know if the alligations are true?" he says, "No! Now I want you guys out!" at this point I am furious and just walk away as my GF continues to speak with his wife. Me, feeling like the situation wasnt resolved, and since 3 seperate people told me hes very bizarre and that he'll look for any rrason to come in the house, We decide to send them a certified letter stating all our concerns. We then get a call stating that they are giving us 60 days to vacate the property. It wasnt even a court or official document, just one they wrote up. Theyre reason for evicting is, and I quote is: "Years ago the doctors at HUP said we need to decrease so and so's stressors". They live in PA and we live in NJ, so we have no clue how we are stressing him out... We are baffled as to why we are getting evicted. I am pretty sure its landlord retaliation and we have already contacted a lawyer cuz this fucker isnt gonna get away with this.
We caught him red handed and so hes evicting us. Our neighbor said its a revolving door of tenants here cuz everyone usually moves out in a year, especally girls cuz hes been caught harassing 2 past women tenants. I dont know if what they are doing is grounds enough to sue but it has caused alot of stess for us, especially our little 4 year old. When we moved here, it was the 2 time hes moved in a year so we were hoping to make it long term for his sake. Sorry for any spelling errors. |

10.06.11 | Forgot to add that he walked in 3 other times when my GF was here and once he was outside our bedroom door calling my name. He walked in cuz he said he was knocking for a half hour and we didnt asnwer. When he walked in when my Gf was here, he just led the comcast guy into our placw without knocking like he was just waking into an empty apartment, not even acknowledging that my Gf could have been nude or just getting out of the shower. Im really hoping that a judge will be on my side. We have all rent alwayspaid on time, take awesome care of our house and have never done anything to these people. I evened painted the place for $500 that was supposed to be taken off our security deposit that we never gave him cuz he let us move in without giving it to him. Fuck I hate this guy. |
AsoTamaki
10.06.11 | Well, damn. It is fucked up that he's evicting you, but it's obviously for the best that you move out of there sooner rather than later. Doesn't seem like a place you'd want to be staying. Just consider it a good thing that you became aware of the situation before any real incidents happened to you guys. I'm sure you're probably not ready to be moving and it sucks to be forced into doing it on his terms, but you should probably focus on finding a place/getting things in order/etc first. Then, once you have that taken care of, look into the law. |
Inveigh
10.06.11 | a buddy of mine had a landlord like that, started telling him he couldn't have more than one other person in the place at any specific time. He was always like making excuses to be around, or right outside the windows and shit. I'm pretty sure he was a serial killer.
either way my advice would be to move asap and continue the litigation in hopes of recovering any losses (plus punitive damages, for you know, stress and shit). |
Vesper
10.06.11 | Um, Dec - not only can you sue him for violating your contract, it sounds like you could also get him for trespassing and sexual harassment. Wtf is up with this guy? |

10.06.11 | The thing is, we spent all our money to move in here. We literally have like $130 in our checking. We just paid rent to them for october and we have nowhere else to go... Having a four year old doesnt make this any easier. Ive been stressed to the max! I thought landlords couldnt evict for no reason? We did not break anything in the lease. We have two witnesses also, the tenant that they just evicted that lived here for 8 years said he would have our backs and the neighbor as well. You cant evict someone just cuz they send you a certified letter stressing their concerns, and then turn around and evict us cuz they say we're putting him under stress. Granted he does have a serious illness, we NEVER did anything to these people. |
Inveigh
10.06.11 | no he can't legally force you out (not sure where you live, but I'm not sure it matters). in Illinois, even after eviction goes into effect they can't physically remove you from the property for a certain period of time, I think it's 90 days. Even when you're not paying rent. It's really ridiculous the amount of rights renters have. |
Inveigh
10.06.11 | but situations like yours are the reasons why we have them. |
foreverendeared
10.06.11 | 1. You need to get some proof other than eyewitnesses that he's doing these things. (A camera setup in the house maybe like a nanny cam on the pc facing the door)
2. Check your lease about eviction. It should state clearly the options for both sides. As a landlord, the contract I wrote up gives me any reason I want to kick out a tenant (as long as I give at least 30 days notice), so check yours to make sure. |

10.06.11 | I live in NJ, Inveigh. I always own up to stuff I do. We have never done anything to break our lease or anything malicious toward eutyer our landlord or his wife. He has been very nosey since we moved in. Of course if we knew this about him we never would have moved here. It only started once we were settled in. And his neighbor is the one who told us what a creep he is with girls. Ive already spoken to a past (female) renter and she said he would do weird shit like see if his key worked on her door at 9pm so she slammed the doorin his face, then another female who said he was in her panty drawer... Only me man, only me would get inti a situation like this. So pissed off its beyond words. |
AsoTamaki
10.06.11 | Yeah, you really need to check the terms of your lease. As messed up and unfair it might be, there may not be much you can do about it. |
Decapod
10.06.11 | Read the lease 100 times. Nowhere in the lease does it say we can be evicted for having concerns about him entering our apartment without 24 ours notice or when we are not home. It states in the lease HE wrote though that he shall obey every law accordingly and provide a safe, habitable dwelling for the renter. Its called, the covenant of quiet enjoyment. |

10.06.11 | "It states in the lease HE wrote though that he shall obey every law accordingly and provide a safe, habitable dwelling for the renter. Its called, the covenant of quiet enjoyment."
You should now revert to the laws in your state about when the landlord is allowed to enter the premises. Most laws specifically say that the renter has to give permission first. In this case, take my advice and get proof he's coming in when not invited via camera or something. |

Okay, this is bullshit. If this guy is mentally unstable, then he needs to get out of the business. I'm sorry, but he can't be a powerful person over other people's lives.
Just stick to the facts. Facts keep your legal house in order as well as your own mental stability. Don't get worked up about things that might not be true. You owe it to yourself as well your family. |

10.06.11 | It says in the lease that he would give us 24-48 hours notice. Now that he knows we're on to him, I doubt he'll try to enter again. Thats why they are trying to evict us. I heard having a child changes everything tho. Like the time he was trimming trees and left his ladder behind which our child started to climb. We're on the second floor and our deck is like 30ft from the ground. If our 4 year old went to high on the ladder, he could have went over the railing and died. |
