this kinda fell off my radar for a bit so i spent some time catching up on the subreddit



from what i understand, the original allegation was apparently proven to be fake... though its not entirely clear how. seems like more screenshots were revealed (through dustie's lawyer?) that shows dustie and the girl had a more consensual relationship than the initial screenshots suggested that lasted months after that... though i'm not sure how that negates the whole rape thing. maybe there's more to it that i'm missing but the initial allegation being false seemed to be more or less consensus on the posts i skimmed through



despite this, the bigger controversy seems to be that other women came out and contacted the mods of the band's official discord server with even more allegations... which were shown to the band but not revealed to the public. in light of dustie performing at furnace fest, the whole mod team resigned and its now being ran by blake on his own(?)



really murky situation and i think its pretty dirty of the band to just quietly let him back in with no announcement or anything like this

really annoying cause a) that furnace fest setlist is dank and under better circumstances i'd love to see them tour the first three albums and b) they are randomly playing colors in full at the august burns red festival like an hour away from me and i want to go so bad but also do not want to be supporting this band right now if this is how they're gonna act

Having just read the statement from the lawyer (if all the additional messages are actually real/exist), it does cast a lot of doubt on the original accusations. This is why I wanted to wait for more details to come out before coming to any conclusions.

"Her messages show that two days after the alleged incident, she made a two-hour trip to visit him in a different city on the tour, during which time they had a second sexual encounter. Over the next few months, she continued to message Mr. Waring on Instagram and sent him numerous explicit messages and photos, making her recent claims of having been impregnated dubious at best. She recounts the details of their sexual encounter (despite claiming not to remember it in her Reddit post), describes it as ‘amazing’, asks him if ‘it was good for him’, tells him ‘thanks for last night, it was crazy fun ’, and agrees that they had ‘good sex’."

@metalphil gotta think if the lawyer is putting out an official statement in which they say they have evidence to the contrary said evidence must be pretty irrefutable (to the best of their knowledge). idk much of anything about law but can't you get disbarred for lying in those?

That's my understanding as well.

It seems like the accuser put out the original post, Dustie's lawyer put out their statement/rebuttal, and that's pretty much been it. No further details/evidence have come out from the accuser.

I don't think one anonymous reddit post, which seems to have been rebutted from the lawyer, is anywhere close to enough to condemn this guy for life.

There are rape/sexual assault accusations where, even if they might not be able to prove it in a court of law, there's enough evidence that I believe the accusers. But as of now, this doesn't seem to be one of those cases.

That said, apparently some other people sent messages to the BTBAM discord mods accusing Dustie of more bad behavior. The mods attempted to contact the band members about it and didn't hear anything back, so the mods "resigned". But the mods weren't willing to release any details of what the alleged bad behavior was. So, don't really want to make judgements on that either unless any actual details come out.

I don't think the band would ever bring him back unless they felt 100% confident in him given how public the whole thing went down. The whole more messages sent to mods thing is nothing, unless it's something. And if it was something, something would have come of it.

Not really. In a court they can't knowingly lie to a judge. But in public they can say whatever, but they'd be putting their own reputation and credibility, as well as the credibility of their clients on the line.
