that's why I'm thinking this person might reeeally be stretching the definition of assault. In the MoBo case, the dude took a girl home, they banged, and then in the morning they banged again. pretty normal stuff. Well then at some point the girl goes straight to the internet (not him) and claims that she verbally consented to the night sex but not the morning sex. dude had NO idea he did something wrong. I suspect this case is very similar.

yeah but usually consent comes in the form of "guy makes move, girl responds well/reciprocates, and it takes off from there." You shouldn't have to physically say "Ashley, would you like to have sex with me?" every time. That's just not how most humans interact with each other. You read body language, you play off the other persons moves.
