it would fly if it the samples were obscured like the ones here

I'd imagine as is the way with recreated samples that you'd have to pay royalties to the owner of the composition only, rather than the performance and composition fee you would pay if you directly sampled the original. Whether these kinds of obscure youtube covers have any copyright protection of they're own, especially considering their derivative nature I'm not sure.
