Yeah it's just half of the riff and that's 3 held open notes, which a lot of bands have done. It's gonna be a tough one to call in court. The only thing you can really argue is that the guitar tone is similar too.

metal bands rip each other off far more than we probably realize. what makes the dear diary instance seem so much more brazen is that it's one very popular metal band ripping off a popular song from another very popular metal band, whereas it's typically a popular band lifting from a more underground band or vice-versa.
