if you charge them for more than just an assault then yes... for a hate crime to occur a crime has to have been commited, and the 'hate' comes from the intention. I'm not suggesting having a prejudice intent excuses the underlying crime not sure how you jumped to that conclusion

If there's a preponderance of evidence that the attack was undertaken due to hatred of a person's identity, then yes, should be punished differently. However as you said, this can be a tricky thing to determine.

I didn't. I guess the whole point of it being treated differently is to draw attention that there are people who will commit a crime just because somebody is different than they are. Basically going against the first amendment and more.
