Well Lateralus was more cerebral and less aggressive than Aenima but didn't really plagiarize it, though Aenima was the beginning of their main sound. I more meant that some of this, like Rosetta Stoned and Right in Two, have sections that sound very similar to Third Eye and 46 & 2.

I'll have to listen more closely as I'd never really noticed before

I think the 'complexities' of the instruments hurt the album. It starts to sound like your avg prog band. And vicarious is without a doubt the best on here.

the guitar parts aren't usually overly complex and definitely have a distinct groove to them that not many bands manage to pull off considering they're done alongside odd and varying time signatures

I agree with this in that I agree that this album sounds less like Tool than their other albums. I think it has to do with the style of guitar playing, the guitar tone, the mixing, and the production. While previous Tool albums had a more claustrophobic, dry production that added to their mystery and power, this one's production is very full and forward and much less subtle. It isn't bad, necessarily, but it doesn't draw me in in the way that their previous LPs did.
That being said, it's still a great album, and Wings for Marie (Parts 1 and 2) is probably my favourite Tool song.
