Nirvana & the baby lawsuit

Spencer Elden, the four-month-old baby baby on the cover of Nirvana's 1991 studio album Nevermind, hasn't given up on his 2021 lawsuit against the band's surviving members, photographer Kirk Weddle, Universal Music, and Courtney Love, in which he claims that the famous cover is child pornography. According to Spin, the now fully grown man, Spencer Elden, has filed an appeal with California's Ninth Circuit Court of Appeals, claiming the statute of limitations doesn't apply, citing Masha's Law - which allows victims of child pornography to seek damages even as adults.



A portion of the appeal goes as follows:

"(Elden) is aware that Appellees are commercially exploiting the frontal nude image of him as a four-month-old child to sell a[n] album to millions of people (many of whom he does not know) around the world," reads a portion of the appeal.

This understandably causes him extreme ongoing psychic or emotional injury for which he is entitled to damages and an injunction. Although this remedy will not rid the world of his sexualized image, it will provide him the means to get mental health treatment and give him the benefit of knowing that the distribution and repeated violation of his privacy by Appellees will finally stop."

Although Spenser is now seeking monetary damages for "extreme ongoing psychic or emotional injury" he has in the past shown both approval and concern on the issue, even recreating the underwater image as an adult.

guess I'm the only one here who thinks it's super weird to put a picture of a naked baby on your album cover. idk what this guy's true intentions are, if he just wants money like people say or if he's actually suffering from this somehow but either way putting pictures of naked kids on your albums is super sus

lol this reminds me when I was a small child... I can't remember exactly but maybe I was like 3 or 4 I dunno... I was at my grandparents' and there was like a kiddie pool or blowup pool in the yard... don't remember if it was their yard or the neighbor's yard, but neighbor kid(s) were out there and I guess I was supposed to go play in the pool with them, but the expectation was that like I was just gonna take my clothes off and be naked to play in the pool...

so basically I, being my insecure self who had only just recently acquired any sense of self awareness, was like "fuck that I ain't going over there with no clothes on" and I cried and threw a fit so I didn't have to go play in the pool

Maybe. Cobain commented on this almost 30 years ago, so it’s probably been brought up multiple times here as well, discussed, conclusions reached, whatever, etc. I’ve always seen the cover same way as when a tot runs around after finding the nude or when changing a baby’s diaper. I understand if someone’s concerned, but there’s also no sexualising in the cover to begin with.

Also, this dude’s been trying to profit off being in the cover for years, telling everyone he can to try and get laid or money or whatever. So, is he trying to exploit the situation and people having been sexually abused? Sounds like it to me, but i don’t know what’s inside his head

Psychic injury seems like a very weird term to use here but maybe I am just dumb lol.
Article cracks me up given the context of them claiming what the album cover is and the image being on the page right below it.
If I remember right dude has done like 3 different pictures recreating it over the years so this whole situation just seems weird to me.

idk, the argument of "he was cool with it before but now he's not so that means he's full of shit" seems troublesome to me. could be true in this case but as a general rule you can be abused and not fully realize it until later on. it's like arguing that if a girl stayed with an abusive partner after the first incidence of abuse then she has no right to speak out about it later on

is it pornography, no, but at the same time what kind of mental process do you have to have to go hey lets hire someones naked baby for our album shoot?

then again theres always scorpions

on the other hand ive always been more concerned with the fact that, unless its just edited (but if it was edited there was no reason to leave the dick in there was there), they seem to have thrown an unable to swim infant into a pool, likely multiple times, to get a picture

I’ve never felt the image was being portrayed as sexual at all but it’s def put me off from listening to the album for years lol. I have a hard time believing that the dude is suffering as much as he says but also it is a little bit fucked up

This isn’t Virgin Killer by Scorpions where a naked prepubescent girl was exposed. This isn’t Blind Faith where a naked teen has her breast exposed. Not Sister by Sonic Youth either. He wants money because he is in debt or wasted his youth. He needs to get a job and shut up.

People are reading way too much into the consent part. Nudity isn’t inherently sexual. People sexualize it like they sexualize anything that looks phallic. It is meant to be a statement on consumerism. Nothing more lol.

Also, love your body. You’re beautiful naked.
