Yeah well....

The divorce and custody laws in this country are just insane
If jess were to be suddenly diagnosed with terminal schizophrenia and married Butler, say they had lots of fun and bore 6 childen. then jess to suddenly decides Butler wasnt the right one for her and decided to divorce him. If Jess wanted custody of the kids, shed have to prove that she was a fit mother, thats it. If Butler wanted custody of the kids, hed have to prove he was a fit father, jess was an unfit mother, he had a regular income, he owned property, he could provide for the kids, could provide with a satisfactory level of education, and had no criminal convictions. Jess on the other hand would have to do none of this, she could have no money, live in a ditch, be a junkie and a mass murderer (sorry jess :D) yet shed still egt custody of the kids as long as she could prove she loves the buggers. Even if Butler were to prove all of those things, as long as Jess is a fit mother, she gets custody.
