MEGADETH's DAVE MUSTAINE Files Counter Lawsuit Against DAVID ELLEFSON

Billboard.biz is reporting that MEGADETH mainman Dave Mustaine has filed a counter lawsuit against former MEGADETH bassist David Ellefson alleging that Ellefson on May 14 executed a settlement agreement in which he gave up his 20% interest in MEGADETH. Mustaine maintains that the settlement — which Ellefson alleges was signed under pressure and ultimately withdrawn — released Mustaine from all claims.

Mustaine's suit, which seeks damages to be determined, was filed in response to Ellefson's original action, filed July 12 in U.S. District Court for the Southern District of New York, which alleges that co-founding guitarist David Mustaine breached their long-running partnership agreement. He claims Mustaine wrongfully took the lion's share of the band's income (estimated at more than $200 million since 1984) for himself and cut Ellefson out of the band's music publishing and merchandise revenues.

Ellefson also says that Mustaine libeled him in an online posting. The bassist is seeking at least $18.5 million in damages.

Thats a good point...but also whats more important to a bands sound a guitar player whos been in metallica for a few years or a singer in the band for 20

supposedly Dave fell asleep with his arm hanging off the chair in a rehab clinic and it damaged it severly, however recently on blabbermouth it seemed he used that as an excuse to break up megadeth, it confusing the way he put it on blabbermouth

yea I read that, it doesn't really explain it, it just says he wanted to show ellefson his hand.

also i cant believe that nick menza is back on board, cos dave m and menza never used to get on very well. i heard dave was real harsh to nick when he booted him out of the band.

Yeah Poland is back in the band (i hear), i wonder why Menza is back in since i thought him and Mustaine had lost their friendship when Mustaine told him to get out.

No, Poland isnt in the band. he just did some leads for the album. Dave called up Nick and made him re-audition for Megadeth to see if he still had it lol. I heard Dave wants to fly out to Japan to talk to Marty.

Marty back in the band........it would be the best thing eva, but i've read so many interviews were marty has said that he would never go back to megadeth etc, so we can only hope!!

It'd b so weird having mustane, meza and friedman in megadeth, but no ellefson...... And it doesnt seem like the 2 daves are being very friendly at all towards each other in recent times. (but theres no point wondering about that cos marty coming back is just a really good dream imo)

Marty has always said "if the time is right" and you just never know. I was fortuante enough to see him in 98' with the band :)

Im pretty sure it was taken off the shelves a while before the remaster shipped

yes, i havent seen a "new" copy of that in years...but used cd's of it of course are still in circulation at local cd shops.

PS: plus the album cover looks a million times better, but the only tee shirt ive seen of KIMB still has the origianl cover on it.

Well..I sorta prefer the new cover of KIMB. And as for it being at local shops I would buy the old one, but I do appreciate a bit better quality on the remaster. Hah, I don't know how it would end up at a used shop, unless you were desperate need of money, who would sell it?

Ya, apparently the record company ****ed up the cover of KIMB back in '85, so the cover you see now from the remastered KIMB is how it was suppose to look like. BTW, I still cant believe Mustaine and Ellefson are feuding in court considering they were pretty much best friends
