Black Eyed Plagiarists?
2009-07-08 by Dr Dave De Sylvia STAFF | 37 Comments
A collective gasp of amazement swept the music world today as it was alleged Black Eyed Pea-In-Chief will.i.am may not be the most original musician in the world.

The source of the allegation in question is electronic musician Freeland (real name: Adam Freeland), who noticed an odd similarity between a 2008 composition of his entitled 'Mancry' (featuring one Tommy Lee on drums) and a track from the new Black Eyed Peas album The E.N.D., entitled 'Party All The Time.'

More specifically, more than one source has put it forward that the Peas straight up sampled 'Mancry' and added their own vocals to the track. The Daily Swarm demands that listeners "check out Lee’s drums as a focal point of the track." Freeland himself has also become involved, tweeting" "Listen to our song 'Mancry'. Now listen to Black Eyed Peas 'Party all the time' WTF!"

WTF indeed. Perez Hilton points out that will.i.am was reportedly in attendance at an event last year where he could have heard the song, while the Swarm has confirmed that legal representatives from the two parties have been in contact with one another.

In the meantime, take a listen to a short (and, we have to say, fairly incriminating) comparison of 'Mancry' and 'Party All The Time'.

Update: In an interview with the Times of Malta (Party All the Times of Malta?), will.i.am revealed that it's not a case of plagiarism, that the band's manager had offered them the beat and the legalities had not been finalised when the record hit stores.

Said Will: "It was a lack of finalising legalities before releasing the record, clearance was not done and that was what it was about."

eh, not to defend the peas, but that synth background was pretty damn generic to begin with. I doubt it was an original freeland creation.

lol the BEP version doesn't even change chords. It's one chord held down for the entire time. There's really no plagiarism involved

I don't hear that little chord change that happens at :20 in the BEP song though. Maybe the vocals are covering it up, but idk.

Hahaha nice.

It sounds like they took the Freeland song and just recorded vocals over it.

The vocals change with the chord changes, so they did at least try to cover it up a little, lol.

could be plagiarism... and i'm sure perez hilton's main concern is artistic integrity.

What a poor excuse for a person.

It's definitely a complete rip-off, but plagiarism suits are always difficult to win in court if you're the plaintiff.

Idk if I would consider this plagiarism because then it would be saying like 80% of low fi ambient artists are and I doubt with the kind of attitude Adam Freeland seems to have that there will be a law suit.
Hopefully this does humble Will i am a bit.

i cant believe either of those can even be called music, let alone plagiarism. its three freaking chords, and yes! OMG! they both found the same exact garageBand sample to play it with! big whoop, both songs blow, but atleast black eyed peas bothered putting something over the worst most basic line in any song, which blows just as hard...
