Date movie.. Stolen drum beat..

I was just watching one of the worst movies i´ve seen "Date movie" and in the end there was a scene (if you have seen it then it is when she is trying to get to her apartment to meet the guy on the roof top) and it had a instrumental song and the drums were completely stolen (almost note for note) from blink 182´s song Violence.

Nothing special but it cought my attention, and it was kinda funny to hear

I happen to like Blink 182 regardless of the stigma that surrounds them because of Travis Barker and the overal overrating of the rest of the members.

My band plays Josie and it's a hella fun song to play (I don't play it like it's meant to be played) regardless of how simple it is.

Can you really steal a drum beat? Besides, you don't know if they got permission or whatever. Music theory/copyrighting/etc. is such a gray area. George Harrison got sued for "unconscious copyright infringement" for My Sweet Lord for pwn's sake.
